about users uploaded content, it's all good until there's control of it... when user upload video it should be check out by reviewers first (like submits on TGPs and Link Lists for example) and if it's good it goes online  this way none of content from paysites would get to tube sites (if owners of all tube sites are honest of course), also it would stop any attempts of uploading other sorts of illegal porn etc... now mentioning that got me thinking, how is that possible that all illegal tubes are clean of beast*,ra*es, cp and other shitty stuff... that means someone does review submits but doesn't block stolen videos from paysites
btw DMCA should be redone in my opinion to clear waters a bit... this is funny how it works at the moment and how it allows anyone to stay clean while having all sorts of shit on his site (server)... it's just not right... why don't i list beast* free sites on my link list when i get some, hey content is not even on my server? because it's not good think to do, simple as that

I agree with part of what you said, however there's some points I must argue.
You say we should review videos...are you kidding? What is this? China? Censorship is a no-no. If something illegal shows up on my site, you can bet your left nut I'll report the uploader to ASACP and/or the proper authorities that control or regulate said content. I make that clear in my TOS. If I start saying what can stay and what can go, that makes me legally liable if something turns out to be copyrighted. So, based on a lawyer's recommendations, EVERYTHING stays until a few people flag it to my attention, at which point it's legality or how objectionable the content might be goes in to play.
If Joe-surfer decides to upload 2 hours of fucking his girlfriend, cool. If that same guy decides to upload a commercial for the newest hybrid car, that's fine to...up until someone clicks FLAG. Once it's flagged, I'll review it. Till then, if I do, I'm putting myself in the "line o' fire" if you will.
I don't put watermarks on my videos, though I could. TOS says if you upload content, you're giving me the right to do essentially whatever I want with it, be it use it for advertising, or chop it up to little pieces, or add a watermark...I'm sure you see where I'm going with this.
My TOS also says if you OWN the video, you can upload it, otherwise you're breaking the law. I'm neither a cop, nor someone who is paid to uphold the law. I'm here to make money, and provide a place where users can interact and upload whatever they please, so long as everyone else on the site thinks it's agreeably decent (AND LEGAL) content.
I refuse to monitor content, and I refuse to pre-screen. Simple as that. I provide an easy way for people to let me know when their copyrighted materials appear on my site, and you had better believe I get a SHITLOAD of notices.
I have recently limited the allowed upload size a bit, and it has helped a bit with curbing uploading of sponsor content, which many, many people tend to like to upload...just like DVD rips. Speaking of DVD rips, tell me why one guy literally uploaded 16GB of DVD content. I deleted it all and sent him a warning, if it happens again, he's toast. No infractions since.
Long post put short:
If I monitor and manually approve videos, I'm 100% legally liable for ANY AND ALL content and ANY AND ALL claims that arise from said content. I refuse to bear that liability, and the *ONLY* legal way by it, is letting users upload whatever they want, then delete the no-no's as they're found. In the mean time, I refuse to play porn-nazi.
